Terms and conditions

1. Organizer

2. Scope of Application

These Terms and Conditions apply to all bookings of activities, tours, courses, rentals, and other services provided by KEIDA Enjoy Mallorca S.L.

By making a booking, the participant agrees to these terms and conditions.

3. Conclusion of Contract

Bookings can be made online via the website, through the booking system, by email, by phone, or on-site.

The contract becomes effective once KEIDA Enjoy Mallorca S.L. confirms the booking.

Payment must be made according to the payment terms specified in the booking system or at the time of booking.

4. Participation Requirements

Participation in the activities requires normal physical fitness and good health.

For water activities, the following additional requirements apply:

  • Participants must be able to swim confidently

  • Participants must not be under the influence of alcohol or drugs

  • Participants must follow the guides’ instructions at all times

Minors may only participate:

  • when accompanied by a legal guardian, or

  • with written consent from a legal guardian.

KEIDA reserves the right to exclude participants from an activity if required for safety reasons.

In such cases, no refund will be granted.

5. Safety and Operation

Before the start of each activity, all participants will receive a safety briefing and behavioral instructions.

The provided equipment must be used according to the given instructions.

Participants agree to:

  • follow all safety rules

  • handle the equipment with care

  • not endanger other participants

6. Weather and Natural Conditions

The offered activities take place in nature and depend on weather, wind, wave conditions, and other environmental factors.

KEIDA Enjoy Mallorca S.L. reserves the right to modify, postpone, or cancel activities for safety reasons.

In such cases:

  • an alternative date will be offered, or

  • the amount already paid will be refunded in full.

No further claims shall apply.

7. Cancellation by Participants

Cancellations must be made in writing (email is sufficient) or by phone.

The following cancellation policy applies:

  • up to 10 hours before the activity starts: free cancellation

  • less than 10 hours before the activity starts: 100% of the price

  • no-show: 100% of the price

The relevant time is the moment the cancellation request is received.

However, we always aim to be flexible. If a booked appointment cannot be attended at short notice, we will try—where possible—to offer a rescheduling option for another date.

8. Changes by the Organizer

KEIDA Enjoy Mallorca S.L. reserves the right to adjust programs, routes, or schedules for organizational or safety-related reasons.

This applies in particular in cases of:

  • weather conditions

  • sea conditions

  • safety requirements

  • official regulations

9. Liability

Participation in all activities is at the participant’s own responsibility and risk.

KEIDA Enjoy Mallorca S.L. is only liable for damages caused by intentional misconduct or gross negligence on the part of the organizer.

In particular, KEIDA assumes no liability for:

  • accidents caused by the participant’s own negligence

  • failure to follow safety instructions

  • risks associated with outdoor and water sports

  • loss, theft, or damage to personal belongings

Liability for Rentals / Self-Guided Activities

When renting equipment (e.g. kayaks, stand-up paddle boards, or other equipment) without a guide, usage is entirely at the renter’s own responsibility.

By taking over the equipment, the renter confirms that they:

  • are able to swim

  • are in suitable physical condition

  • understand and comply with KEIDA Enjoy Mallorca S.L.’s safety instructions

The renter agrees to treat the rented equipment with care and use it only for its intended purpose.

The renter is liable for damage to or loss of rented equipment during the rental period if caused by improper use or negligence.

KEIDA Enjoy Mallorca S.L. is not liable for damages or accidents resulting from the independent use of rented equipment unless caused by gross negligence or intentional misconduct by the company.

10. Use of Equipment

Participants are provided with equipment for the duration of the activity (e.g. kayaks, SUP boards, paddles, life jackets, waterproof bags).

Participants agree to:

  • handle the equipment with care

  • report any damage or loss immediately

In cases of intentional damage or gross negligence, participants may be held liable for the resulting damages.

11. Insurance

KEIDA Enjoy Mallorca S.L. has the legally required liability insurance.

Participants are responsible for ensuring they have adequate personal accident or travel insurance coverage.

12. Photo and Video Recordings

Photos and videos may be taken during activities.

These may be used for:

  • website content

  • social media

  • marketing purposes

Participants may object to the use of their images at any time.

​

13. Data Protection

Personal data will only be used for the execution of booked services and communication with participants.

Further information can be found in the privacy policy on the website.

14. Severability Clause

Should any provision of these Terms and Conditions become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

15. Applicable Law and Jurisdiction

Spanish law shall apply.

The place of jurisdiction—where legally permissible—is the registered office of KEIDA Enjoy Mallorca S.L. in the Balearic Islands (Spain).
